An order restraining the defendants from using labels, artistic works, colour combinations, packaging designs, and layouts substantially similar to those of the plaintiff.

3. Injunction Against Passing Off

A direction prohibiting the defendants from presenting their products in a manner likely to mislead consumers into believing that the products originated from or were associated with the plaintiff.

4. Destruction of Infringing Materials

The plaintiff also sought surrender and destruction of all products, labels, cartons, moulds, packaging materials, and other articles bearing the impugned mark.

5. Rendition of Accounts and Profits

A request for disclosure of profits earned through the use of the disputed mark and payment of such profits to the plaintiff.

Settlement Between the Parties

During the pendency of the proceedings, the parties entered into a Joint Memorandum of Compromise dated 25 March 2026.

Under the settlement:

  • The defendants agreed to change their trademark.
  • The parties requested the Court to dispose of the suit in terms of the compromise.
  • The plaintiff agreed to relinquish its claims relating to destruction of goods and rendition of accounts of profits.
  • The defendants accepted the injunctions relating to trademark infringement, copyright infringement, and passing off.
